What are the penalties for not having a fire risk assessment?
By Joe Cooper · · 3 min read
If you do not follow fire safety law, you could face enforcement action, fines and in serious cases prison. GOV.UK says you could be fined or go to prison. Having a current written assessment and good records is the best protection.
What can happen
- An inspector can issue an enforcement notice requiring changes.
- A prohibition notice can restrict use of all or part of the premises if there is a serious risk.
- In serious cases you can be prosecuted, with fines and potentially imprisonment.
Other consequences
A fire can also lead to injuries, damage and loss of trade, and insurers may query a claim if you cannot show you managed fire risks.
What helps
- A written, dated fire risk assessment.
- Records of weekly checks, servicing, training and drills.
- Fixing faults promptly and recording it.
